SME Ghana Awards – Terms and Conditions
These Terms and Conditions (“Terms”) govern your participation in the SME Ghana Awards (“Awards”). By entering or participating in the Awards, you agree to be bound by these Terms and any additional rules provided from time to time. If you do not agree with these Terms, please do not participate in the Awards.
- Definitions
- Awards: The SME Ghana Awards organized to recognize excellence among small and medium-sized enterprises in Ghana.
- Organizer: The entity responsible for administering the Awards. In these Terms, “we”, “us” or “our” refers to the Awards Organizer.
- Participant: Any individual, business, or organization that submits an entry for the Awards.
- Entry: Any submission made by a Participant, including written materials, supporting documents, or any form of digital submission as specified by the Awards guidelines.
- Submission Period: The time period during which entries will be accepted as detailed in the Awards call for entries.
- Eligibility and Entry
- Eligibility: The Awards are open to all eligible small and medium-sized enterprises based in Ghana. By entering, Participants warrant that they meet the eligibility criteria as set out in the Awards guidelines.
- Entry Submission: Participants must submit entries in accordance with the specifications provided in the Awards call for entries. All entries must be complete, original, and not infringe on any intellectual property rights.
- Multiple Entries: Unless otherwise stated, each Participant is allowed only one entry per category. Duplicate submissions may be disqualified at the discretion of the Organizer.
- Judging and Awarding
- Judging Panel: A panel of expert judges will review all eligible entries. The judging process will be conducted impartially, and decisions on the merits of entries are final and binding.
- Criteria: Entries will be judged based on innovation, impact, business practices, and overall excellence. The Organizer reserves the right to adjust judging criteria in its sole discretion.
- Notification of Winners: Winners will be notified via the contact details provided during submission and announced publicly within [specify timeframe]. If a Participant cannot be reached, the Organizer reserves the right to award the prize to the next eligible submission.
- Intellectual Property
- Ownership of Entries: Participants retain ownership of the content provided in their entries. However, by submitting an entry, you grant us a non-exclusive, royalty-free, irrevocable license to use, display, distribute, and reproduce your entry for promotional and archival purposes related to the Awards.
- Third-party Materials: Any content supplied by Participants that includes third-party materials must have all necessary permissions, and Participants will be solely responsible for any infringement claims.
- Data Privacy and Confidentiality
- Personal Data: The Organizer will process your personal data in accordance with applicable data protection laws and our [Privacy Policy]. By entering the Awards, you consent to the processing of your data for the purposes of administering the Awards.
- Confidential Information: Participants must keep any confidential information received from the Organizer in connection with the Awards confidential and shall not disclose it to any third party without prior written consent.
- Limitation of Liability
- Disclaimers: The Awards and any prizes are provided “as-is” without any warranty of any kind. We expressly disclaim any representations or warranties, either express or implied, including any warranties of merchantability or fitness for a particular purpose.
- Liability Cap: To the fullest extent permitted by law, the Organizer’s total liability in connection with the Awards shall not exceed the value of the prize awarded to the Participant.
- Indemnity
Participants agree to indemnify, defend, and hold harmless the Organizer, its officers, employees, and agents, from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from or related to:
- Any breach of these Terms,
- Any claim that the Participant’s entry infringes on any intellectual property or other rights of a third party, or
- The Participant’s negligence or misconduct in connection with the Awards.
- Termination and Suspension
- Right to Terminate: The Organizer reserves the right to cancel, modify, or suspend the Awards at any time without prior notice for any reason, including circumstances beyond our control. In the event of termination, no compensation will be provided to any Participant.
- Disqualification: Any Participant found to be in breach of these Terms, or engaging in any fraudulent or unethical behavior, may be disqualified and any associated prizes forfeited.
- Dispute Resolution and Governing Law
- Arbitration: Any dispute arising out of or in relation to these Terms or the Awards shall be resolved through arbitration in accordance with the rules of an arbitration body designated by the Organizer. The decision of the arbitrator will be final and binding.
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ghana, except where arbitration is required.
- Miscellaneous
- Amendments: The Organizer reserves the right to change these Terms at any time. Any changes will become effective upon posting on the Awards website or notifying Participants via email.
- Severability: If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
- No Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of future enforcement of that or any other provision.
